    Agenda

    1. General Public Comment

      The public is now welcome to address the Commission regarding items that do not appear on tonight’s agenda but that are within the subject matter jurisdiction of the Commission.  Speakers shall address their remarks to the Commission as a whole and not to individual Commissioners or Department or DPA personnel.  Under Police Commission Rules of Order, during public comment, neither Police or DPA personnel, nor Commissioners are required to respond to questions presented by the public but, may provide a brief response.  Individual Commissioners and Police and DPA personnel should refrain, however, from entering into any debates or discussion with speakers during public comment.

    2. Discussion and possible action to adopt findings for the Police Commission to continue to meet via teleconferencing technology per Assembly Bill 361 (DISCUSSION & POSSIBLE ACTION)
    3. Chief’s Report (DISCUSSION)
      • Weekly crime trends (Provide an overview of offenses occurring in San Francisco)
      • Major/Significant Incidents (Provide a summary of planned activities and events.  This will include a brief overview of any unplanned events or activities occurring in San Francisco having an impact on public safety.  Commission discussion on unplanned events and activities the Chief describes will be limited to determining whether to calendar for a future meeting.)
    4. DPA Director’s Report (DISCUSSION)

      Report on recent DPA activities, and announcements (DPA’s report will be limited to a brief description of DPA activities and announcements.  Commission discussion will be limited to determining whether to calendar any of the issues raised for a future Commission meeting.)

    5. Commission Reports (DISCUSSION)

      (Commission reports will be limited to a brief description of activities and announcements.  Commission discussion will be limited to determining whether to calendar any of the issues raised for a future Commission meeting.)

    6. Discussion regarding Order re: Plaintiff’s Motion for Sanctions in Spiers v. City and County of San Francisco, Case No. 20-cv-01357-JSC (DISCUSSION)
    7. Update from the Department regarding First Amendment Compliance Audit of San Francisco Police Department Records pursuant to Department General Order 8.10 (DISCUSSION)
    8. Presentation of the SFPD/DPA Report on General Orders/Policy Proposals “Sparks Report,” (DISCUSSION)

      3rd and 4th Quarter 2021; Per Police Commission Resolution 27-06 requiring the Department and the DPA to submit a quarterly report regarding the status of policy proposals & recommendations under consideration by the Department or DPA 

    9. Public comment on all matters pertaining to Item 11 below, Closed Session, including public comment on Item 10, vote whether to hold Item 11 in closed session.
    10. Vote on whether to hold Item 11 in Closed Session, including vote on whether to assert the attorney-client privilege with regards to Item 11(b) (San Francisco Administrative Code Section 67.10) (ACTION)
    11. Closed Session

      Roll Call;

      a.    CONFERENCE WITH LABOR NEGOTIATOR – COLLECTIVE BARGAINING. This item is for the Commission to meet in closed session with their labor negotiator and provide direction for bargaining with the San Francisco Police Officers Association (POA).  The POA is not permitted to attend this closed session meeting.

             Pursuant to Government Code Section 54957.6 and San Francisco Administrative Code Section 67.10(e):

      b.    CONFERENCE WITH LEGAL COUNSEL – Existing Litigation.  Pursuant to Government Code Section 54956.9(d)(1) and San Francisco Administrative Code Section 67.10(d)(1): 

      Michael Kliment et al. v. City and County of San Francisco, et al., U.S. District Court, N.D.C.A., C.A., Case No. 3:20-cv-03257-YGR, filed May 13, 2020 (ACTION)

      c.     PERSONNEL EXCEPTION.  Pursuant to Government Code Section 54957(b)(1) and San Francisco Administrative Code Section 67.10(b) and Penal Code Section 832.7:

              Hearings on non-disciplinary charges and possible action on dismissal, or other action, if necessary, on the following cases: (ACTION)

              Status and calendaring of pending disciplinary cases (ACTION)

    12. Open session - Vote to elect whether to disclose any or all discussion on Item 11 held in closed session (San Francisco Administrative Code Section 67.12(a)) (ACTION)
