Ask for a rehearing
After an appeal hearing with the Board of Appeals, you can file a request for a rehearing.

You must file a Rehearing Request within 10 calendar days of the Board’s decision.
What to do
1. File within 10 days
If you are dissatisfied with the Board’s decision, in most cases you can file a Rehearing Request.
You must file the Rehearing Request within 10 calendar days from the date of the Board's decision. If the 10th day is a weekend or City holiday, you must file the request by the next business day.
You can only file 1 Rehearing Request for an appeal.
Only parties to an appeal can ask for a rehearing.
2. Pay
It costs $150 to file a Rehearing Request. You can pay after you file.
You can mail a check, made payable to the Board of Appeals, to:

3. Submit your written statement
You must submit a written statement when you request a rehearing. The statement must be:
- No more than 6 pages
- At least 12 point font
- Double spaced
Your statement can have as many exhibits as you need.
The other party has 10 days to submit a response to your Rehearing Request.
All briefing submissions should be sent to boardofappeals@sfgov.org
4. At the hearing
Each party will only have 3 minutes to present their case.
Members of the public who are unaffiliated with either party can also speak for up to 3 minutes.
The Board will then vote on whether to allow a rehearing.
You must have 4 out of the 5 Board votes to get a rehearing.
The Board may grant a rehearing request when a rehearing is needed to prevent manifest injustice. They will also grant a rehearing request if there is new or different information that could have changed the original Board determination.
If the board decides to rehear your case, we will schedule the rehearing for a future date. Rehearings are usually scheduled within 45 days.
Rehearings have the same process and deadlines as your original appeal.
