Upcoming changes to Security Deposit laws - Photograph requirements
Beginning April 1, 2025, landlords are required to provide photographic evidence before or at the beginning of the tenancy, and if the landlord withholds part of a tenant’s security deposit for repairs or cleaning.
Changes to Security Deposit laws - Photograph Requirements
California Assembly Bill 2801 now requires landlords to provide photographic evidence if withholding part of a tenant’s security deposit for repairs or cleaning.
Beginning April 1, 2025, landlords must take photographs of the unit:
- Within a reasonable time after possession of the rental unit was returned to the landlord, but prior to any repairs or cleanings for which a deduction is made; and,
- Within a reasonable time after repairs or cleanings for which a deduction is made are completed.
In addition, for tenancies that begin on or after July 1, 2025, a landlord must take photographs of the unit immediately before, or at the beginning of the tenancy.
