Filing an OLSE appeal with the Controller's Office

For OLSE Appeals, various San Francisco Administrative Code sections designate the Controller’s Office as the department responsible for managing the appeals of determinations made by other departments. This role is to ensure that the appellant receives a fair and unbiased adjudication of the matter.

Submit a request for Appeal and complete the Administrative Appeals Intake Survey

Time:

5 minutes

When submitting your request for appeal, please also submit the Administrative Appeals Intake Survey. This survey is required for an appeal. It should be completed by one member of each party. If you have questions, please contact Controller.AdministrativeAppeals@sfgov.org.

If this appeal is for Prevailing Wage, the parties will enter into a Meet & Confer in good faith period which lasts 30-days.

Time:

30 days

If no resolution is agreed upon or if no party requests the appointment of a hearing officer by the deadline, the Certification of Forfeiture shall be deemed final.

If a fine is required for an appeal, submit the fine

Time:

5 minutes

If a fine is required for an appeal, submit the fine. The Controller's Office will accept checks and in some instances another form of security.

Appointing a Hearing Officer

Time:

2 weeks

When the Controller's Office receives your request for an appeal, we will work with our pre-qualified pool of contracted Hearing Officers to appoint an arbiter to this matter.

Hearing & Pre-Filing dates are established

Time:

1 week

Once unavailable dates are received, the Controller's Office and the hearing officer will work to analyze the data and establish clear dates leading up to a hearing/

Submit Dates for Scheduling

Time:

1 week

Once the Hearing Officer is appointed, the Parties will be asked to submit a series of dates where they are unavailable to meet for a hearing. Scheduling for hearings can be difficult. The Controller’s Office respectfully requests that, “unavailable” is interpreted as a vacation or attending to another legal matter.

Submit pre-filing documents by date

Time:

6-8 weeks

Please submit required documentation by their established due date before the hearing. These pre-filings help the Hearing Officer understand the details of the case.

Attend virtual public hearing

Time:

1-2 days

Please attend the public hearing on the agreed upon hearing date. Both parties will be give the opportunity to call witnesses and submit evidence. Each side will have equal amounts of time to explain their case. Often times hearings are only a few hours long, but occasionally extra time is needed. Hearings are held on MS Teams. Public Notices are found here.

Submit Statements of Facts and other documentation by agreed upon due date

Time:

1-2 weeks

At the hearing, the Hearing Officer will clearly outline expectations for next steps. This can include submitting Statements of Facts and other documentation by agreed upon due date.

Hearing Officer Issues their decision

Time:

2 weeks after hearing

The Hearing Officer will issue their decision and it will be distributed by the Controller's Office to the Parties.
