Annual Rent Increase for 3/1/19-2/29/20 Announced
Effective March 1, 2019 through February 29, 2020, the allowable annual increase amount is 2.6%. In accordance with Rules and Regulations Section 1.12, this amount is based on 60% of the percentage increase in the Consumer Price Index (CPI) for All Urban Consumers in the San Francisco-Oakland-San Jose region for the 12-month period ending October 31, which was 4.4% as posted in November 2018 by the Bureau of Labor Statistics.
To calculate the dollar amount of the 2.6% annual rent increase, multiply the tenant's base rent by .026. For example, if the tenant's base rent is $1,500.00, the annual increase would be calculated as follows: $1,500 x .026 = $39.00. The tenant's new base rent would be $1,539.00 ($1,500.00 + $39.00 = $1539.00).

Rent Board Amends the Rules and Regulations re O&M Petitions and Certain No-Fault Eviction Notices
After a public hearing on September 11, 2018, the Rent Board Commissioners approved proposed amendments to Rules and Regulations Sections 6.10 and 12.17 regarding Operating and Maintenance petitions and certain no-fault eviction notices.
The amendment to Rules and Regulations Section 6.10 was in response to a recent amendment to Rent Ordinance Section 37.8(e)(4) by the Board of Supervisors, which prohibits landlords from seeking rent increases on existing tenants due to increases in debt service and property tax that have resulted from a change in ownership and to prohibit landlords from seeking rent increases due to increased management expenses unless the expenses are reasonable and necessary.
The amendment to Rules and Regulations Section 12.17 allows the Rent Board to request that Notices to Vacate under Rent Ordinance Sections 37.9(a)(9), 37.9(a)(10), 37.9(a)(11), and 37.9(a)(14) state the tenant’s rent as required by Rent Ordinance Section 37.9(c).

Rent Board to Hold Public Hearing on 9/11/18 on Amendments to its Rules and Regulations Regarding Operating and Maintenance Petitions and Rent Board Procedures re Certain No-Fault Eviction Notices
At their regular meetings on July 10, 2018 and August 14, 2018, the Rent Board Commissioners considered possible amendments to Rules and Regulations Sections 6.10 regarding landlord petitions for rent increases based on increased operating and maintenance expenses. The amendments are in response to the passage of Ord. No. 132-18 by the San Francisco Board of Supervisors that became effective on July 15, 2018.
At their August 14th meeting, the Commissioners also considered a proposed amendment to Rules and Regulations Section 12.17. The amendment is in response to a report from Rent Board staff that some notices to vacate under Rent Ordinance Sections 37.9(a)(9), 37.9(a)(10), 37.9(a)(11) and 37.9(a)(14) do not state the tenant’s rent as required by Ordinance Section 37.9(c). The proposed amendment would allow the Rent Board to request that the notice state the tenant’s rent.
At their August 14th meeting, the Commissioners voted to hold a public hearing on the proposed amendments to Rules and Regulations Sections 6.10 and 12.17. The public hearing will be held on September 11, 2018 in room 70 (lower level) at 25 Van Ness Avenue in San Francisco and begins at 6:30 pm.
Interested parties may attend the public hearing to comment on the proposed amendment to the regulations and/or submit written comments. Written comments should be received at the Rent Board’s office no later than noon on September 6, 2018, so that the Commissioners have adequate time to review them prior to the public hearing. Written comments (16 copies, please) may also be submitted at the hearing.

New Ordinance Amendments re Operating and Maintenance (O&M) Petitions
Effective July 15, 2018, Section 37.8 of the Rent Ordinance was amended to limit consideration of increases in debt service and property taxes following a change of ownership, as well as management expenses, when a landlord seeks to increase the tenants’ rents based on increased operating and maintenance (O&M) expenses. A copy of the legislation is available here [Ord. No. 132-18]. In order to implement the new legislation, the Rent Board Commissioners are considering possible amendments to Rules and Regulations Section 6.10.

California Supreme Court Denies Review of Court of Appeals Decision Upholding Ordinance Amendment re Increased Eviction Protections for School Employees and Families with Children During the School Year – Update #4 (4/25/18)
Effective May 22, 2016, Section 37.9(j) of the Rent Ordinance was amended to limit certain no-fault evictions during the school year if a child under 18 or a person who works at a school in San Francisco (an “educator”) resides in the unit, the child or educator is a tenant in the unit or has a custodial or family relationship with a tenant in the unit, and the tenant has resided in the unit for 12 months or more. The amendment also deleted a prior exception for certain owners that applied to owner move-in evictions during the school year. For more information about the scope of the amendment, see the 2016 “What’s New” item entitled New Eviction Protections for School Employees and Families with Children During the School Year.
Following a lawsuit by the San Francisco Apartment Association and Small Property Owners of San Francisco Institute, the San Francisco Superior Court enjoined the City from enforcing the Ordinance amendment on August 31, 2016 in the case of SFAA v. CCSF, Case No. CPF-16-515087. On October 11, 2016, the City appealed the Superior Court's ruling and on February 14, 2018, the California Court of Appeal issued a published decision upholding the legality of the Ordinance amendment. [SFAA v. CCSF, No. A149919] On April 25, 2018, the California Supreme Court denied the plaintiffs’ petition for review.

Court of Appeal Upholds Ordinance Amendment re Increased Eviction Protections for School Employees and Families with Children During the School Year - Update #3 (2/14/18)
On October 11, 2016, the City appealed the Superior Court's August 31, 2016 ruling in SFAA v. CCSF that enjoined the City from enforcing Ordinance No. 160100 (no-fault eviction protections during the school year for students and educators). On February 14, 2018, the Court of Appeal issued a published decision upholding the legality of the Ordinance. While the appellate court reversed the trial court’s Order, the decision is not yet final and the injunction prohibiting the City from enforcing the Ordinance remains in effect pending further appeal. To calculate the dollar amount of the 1.6% annual rent increase, multiply the tenant's base rent by .016. For example, if the tenant's base rent is $1,500.00, the annual increase would be calculated as follows: $1,500 x .016 = $24.00. The tenant's new base rent would be $1,524.00 ($1,500.00 + $24.00 = $1524.00).
