Requirements

Passive meeting bodies (PMBs) are not subject to the broad array of open government requirements that apply to policy bodies. Gatherings of PMBs must be open to the public and must occur in facilities accessible to the disabled, but otherwise, they need not occur in any particular space for accommodating the public.

The public has the right to observe on a space-available basis consistent with legal and practical restrictions on occupancy. Admin. Code §§ 67.4(a), (a)(2). Also, the requirements for creating and posting agendas for meetings do not apply to PMBs. PMB gatherings must be noticed on the relevant City website whenever possible. Admin. Code § 67.4(a)(1). There is no time deadline for posting this notice, but if possible the department should post it to allow reasonable time for interested members of the public to arrange to attend. If a member of the public requests the time, place, and nature of an upcoming gathering, the body must disclose that information. Admin. Code § 67.4(a)(1). PMB gatherings need not allow for public comment. Admin. Code § 67.4(a)(3).
